ASTAG Opposes State Wage Dictation in the Transport Industry

August 2022In light of the ongoing massive problems faced by the road transport industry in conducting cross-Alpine transit traffic through Tyrol, the Federal Association of Goods Transport, Logistics and Disposal (BGL) e.V. from Frankfurt am Main has initiated a formal complaint regarding a violation of EU law.
(Frankfurt/Main) Specifically, the BGL and numerous other European logistics associations and chambers of commerce have submitted a formal complaint to the EU Commission against the general night driving ban for trucks on the Inntal Autobahn, which has been in effect since January 1, 2021, and the resulting massive restriction of the fundamental freedom of free movement of goods within the Union guaranteed by EU treaties. The BGL is also examining and planning to file a formal complaint with the EU Commission regarding other existing measures in Tyrol, such as the sectoral driving ban and traffic management (block processing).
Most Important Road Connection Between Germany and Italy
The affected section of the Inntal Autobahn is the most important road connection between Germany and Italy. The night driving ban is an disproportionate measure that significantly impairs the interests of the economy. The night driving ban was introduced and justified with the aim of improving air quality. However, the opposite is achieved: the drastic reduction of time windows available for road freight transport to daytime hours leads to unnecessary traffic congestion and negatively affects fuel consumption and air quality due to artificial traffic jams. Moreover, the night driving ban discriminates against transport companies based outside the core zone of Tyrol, as companies loading or unloading in the core zone of Tyrol are exempt from the night driving ban. Other modes of transport, such as rail, with their far too low capacities, do not provide a viable alternative to road transport.
Review Within 12 Months
The EU Commission will review the formal complaint within 12 months and decide whether to initiate formal infringement proceedings against the respective member state.
