August 2022The Administrative Court based its decision on a ruling from the Federal Administrative Court obtained by the Federal Association of Parcel and Express Logistics (BIEK) in 2020, which had already annulled the previous postal approval from 2015 as unlawful. From the court’s perspective, the amendment to the Postal Act passed by the Bundestag in 2021 does not rectify the legal errors of the postal approval. In addition to BIEK, the German Pension Insurance, the Berlin Bar Association, and the companies Arriva, Postcon, PIN, and Letterei filed lawsuits against the approval.
(Berlin) BIEK Chairman Marten Bosselmann welcomes the decision of the Administrative Court. He states: “The ruling once again confirms our legal position. By remaining inactive, the BNetzA has tolerated excessive postal rates to the detriment of letter customers. Furthermore, it has enabled significant distortions of competition for DPAG in the parcel market. The current legal situation, under which unlawful profits of such magnitude can remain with DPAG, must be urgently changed. A consumer- and competition-friendly amendment to the Postal Act is long overdue!”
